刑事诉讼中律师的调查取证权是程序公正的一个不可或缺的支柱,是整个刑事诉讼中最重要的环节.我国现行《刑事诉讼法》中的某些规定体现了律师的部分调查取证权,但由于缺乏有力的制度保障,律师调查取证权无法真正得以实现,实践中遇到侵害时更难以救济.本文通过分析我国现行法律中律师调查取证权存在的问题,比较了两大法系主要国家刑事诉讼法中律师调查取证权的特点,结合我国司法实践的现状,提出了完善我国刑事诉讼中律师调查取证权的建议.

Criminal procedure law of the RI is that just an indispensable pillar,is the entire criminal proceedings in the most important aspects.China's criminal procedure law of certain requirements embodied the lawyers section RI,but because of the lack of a strong system of protection,lawyer RI could not real,practical experience when more difficult to remedy.This article by analyzing existing law lawyers RI problem,compare the two major national criminal procedural law in RI,combined with the current situation of judicial practice in China,it has made the improvement of criminal procedure law RI's proposal.
